化学工业劳动就业服务企业管理办法
1992年4月15日,化工部

第一章 总则
第一条 为贯彻国务院发布的《劳动就业服务企业管理规定》,促进化学工业劳动就业服务企业的健康发展,结合行业实际,制定本办法。
第二条 化学工业全民所有制企事业单位(简称主办单位)主办的劳动就业服务企业,是由国家和主办单位扶持、以安置主办单位待业人员、发展集体经济为主要任务的集体所有制经济组织。
第三条 劳动就业服务企业必须贯彻执行国家的方针、政策和法律、法规,坚持就业服务方向,在核准登记的经范围内从事生产经营活动。
第四条 主办单位依照国家法律、法规和政策规定,保护劳动就业服务企业的合法权益,在政治上、经济上平等对待,不得侵占、平调劳动就业服务企业的财产。
第五条 化工劳动就业服务企业是化学工业的重要组成部分,在开展劳动就业服务工作中,要为深化企业改革服务;为调动职工生产积极性服务;为搞好主办单位服务;为发展化学工业服务。

第二章 管理体制
第六条 化学工业部劳动安全司对本行业劳动就业服务企业实行工作指导,其职责是:
(一)指导和监督劳动就业服务企业贯彻执行国家有关方针、政策和法律、法规;
(二)制定化工行业劳动就业服务企业的发展规划;
(三)协调劳动就业服务企业与部门内各有关方面的关系;
(四)提供生产、技术、经营等方面的咨询,组织物资、科技等方面的信息交流;
(五)开发专业技术岗位培训工作;
(六)评选和表彰先进集体、个人,交流工作经验;
(七)对劳动就业服务企业发生的重大问题进行调查研究,向有关部门反映情况,提出处理意见;
(八)负责直属劳动就业服务企业的产品评优、科研成果鉴定的审查推荐工作。
第七条 地方化工主管部门对本地区化工劳动就业服务企业实行系统管理,其职责是:
(一)贯彻执行化工部和地方人民政府的有关方针政策和工作部署;
(二)负责直属单位新开办的劳动就业服务企业注册登记前的审批工作;
(三)制定地区化工劳动就业服务企业的发展规划;
(四)协调劳动就业服务企业与主办单位和各职能部门的业务关系;
(五)帮助劳动就业服务企业进行跨行业、跨地区的经济技术合作和经济联合;
(六)参与研究劳动就业服务企业经营责任制的制定,指导劳动就业服务企业各项专业管理工作;
(七)开发各类专业培训工作;
(八)会同有关部门,纠正违反国家方针、政策和法律、法规的行业。
第八条 主办单位对劳动就业服务企业实行直接管理,其职责是:
(一)劳动就业服务企业开办时,帮助企业办理审批和工商登记手续;
(二)发挥主办单位优势,扶持劳动就业服务企业发展生产,搞活经济,提供各种生产经营条件;
(三)协调劳动就业服务企业与主管部门以及地方综合管理部门的关系;
(四)指导劳动就业服务企业研究制定发展规划和建立完善各项规章制度;
(五)任用或招聘劳动就业服务企业经理(厂长);
(六)负责劳动就业服务企业专业技术人员职称和工人技师评聘工作;
(七)组织审查并归口申报劳动就业服务企业产品评优和新技术成果鉴定材料;
(八)协调解决劳动就业服务企业的其他问题。
第九条 主办单位对扶持劳动就业服务企业的资金、设备等,应当坚持有偿使用原则:
(一)扶持资金可作为借用款由劳动就业服务企业按双方约定分期归还,也可依法作为投资参与劳动就业服务企业的利润分配;
(二)设备、工具等生产资料和厂房可在合理作价的基础上由劳动就业服务企业一次或分期付清;主办单位也可采用出租形式,收取相当于折旧费的租金;
主办单位收取的资金可作为再扶持资金用于劳动就业服务企业安置待业人员和发展生产使用。

第三章 权利与义务
第十条 劳动就业服务企业在国家法律、法规的规定范围内享有下列权利:
(一)对自有财产享有占有、使用、收益和处分的权利,拒绝任何形式的平调;
(二)自主安排生产、经营、服务活动;
(三)自主决定本企业的机构设置、人员编制;
(四)享受国家、地方、部门给予的税收、信贷、物资、资金等方面的优惠待遇;
(五)依法奖惩职工。
第十一条 劳动就业服务企业应当承担下列义务:
(一)遵守国家法律、法规;
(二)按照规定向主管部门缴纳管理费,依法缴纳税金;
(三)根据企业条件,承担安置主办单位待业人员任务;
(四)依法履行合同;
(五)维护职工合法权益,尊重职工的民主管理权利,改善劳动条件,在生产发展的同时,提高职工物质文化生活水平。

第四章 经理(厂长)
第十二条 劳动就业服务企业经理(厂长)由主办单位推荐、招聘,或经职工(职工代表)大会选举产生,报上级主管部门同意备案后,由主办单位任命,其他干部由劳动就业服务企业自行任免。
第十三条 劳动就业服务企业的经理(厂长)实行任期负责制。期满后可以连任,任期内无法定理由,主办单位不得擅自对经理(厂长)予以罢免或调动。
第十四条 大型劳动就业服务企业的经理(厂长),由相当于主办单位副职的干部担任或兼任;中型及其以下劳动就业服务企业的经理(厂长),由相当于主办单位中层一级的干部担任。
第十五条 经理(厂长)应当具备下列条件:
(一)懂得有关法律、法规和方针、政策,坚持企业的社会主义经营方向;
(二)熟悉本职业务,善于经营管理,有组织领导能力;
(三)热爱集体,廉洁奉公,联系群众,有民主作风;
(四)法律、法规规定的其他条件。
第十六条 经理(厂长)在法律法规规定范围内行使下列职权:
(一)领导和组织企业日常生产经营和行政工作;
(二)主持编制企业发展规划、年度安置待业人员和生产经营计划、固定资产投资方案;
(三)按照国家规定和干部管理权限任免企业中层行政干部;
(四)提出企业的经济责任制方案、工资调整方案、劳动安全保护措施方案、奖惩办法和其他重要的规章制度;
(五)提出企业年度财务预算、决算方案和利润分配方案;
(六)提出企业内部机构设置方案、决定劳动组织的调整方案;
(七)国家法律、法规规定的其他职权。
第十七条 经理(厂长)有下列职责:
(一)贯彻执行党和国家的方针、政策,遵守国家的法律、法规,执行职工(代表)大会的决议;
(二)组织完成企业生产经营任务和各项经济技术指标,改善经营管理,推进技术进步,提高经济效益,增强企业安置待业人员和发展生产的能力;
(三)严格遵守财经纪律;
(四)保护企业的合法权益和职工的正当权利;
(五)组织落实安全卫生措施,实现安全文明生产;
(六)法律和法夫规定的其他职责。

第五章 生产经营管理
第十八条 劳动就业服务企业要坚持自主经营、独立核算自负盈亏的原则,主办单位要尊重劳动就业服务企业的经营自主权。
第十九条 劳动就业服务企业要加强基础管理和专业管理,建立和完善各项规章制度,按照企业管理要求组织生产经营活动,逐步提高管理水平。
第二十条 劳动就业服务企业从事化工生产,必须严格执行国家产品技术质量标准、安全生产、环境保护等专业法规,不具备条件的企业不得生产。
第二十一条 劳动就业服务企业可报请主办单位和主管部门会同地方综合部门同意,实行适合本企业特点的经营方式,同时建立和完善内部经济责任制。
第二十二条 主办单位要大力扶持劳动就业服务企业开展生产经营活动。凡劳动就业服务企业能够承办的项目,如为主办单位生产加工配套产品、基建施工、生活服务等,在保证质量和不增加费用支出前提下,主办单位优先交由劳动就业服务企业承办。
第二十三条 主办单位要支持劳动就业服务企业利用本企业废渣、废液、废气或边角余料、废料开发生产各种产品,列入环保项目的,要报请地方有关部门给予一定的优惠政策。
第二十四条 劳动就业服务企业生产所需物资实行市场调剂为主、计划供应为辅的原则。凡列入主办单位产品计划或为主办单位加工延伸配套系列产品、制作备品配件等所需原材料,由主办单位作为生产用料予以解决。
第二十五条 劳动就业服务企业生产的国家、部、省优质产品、出口创汇产品,所需原材料由主办单位按其隶属关系,报请上级计划物资部门协调解决。

第六章 财务管理
第二十六条 劳动就业服务企业与主办单位应当明确划清产权和财务关系,严格执行国家有关财务、会计制度,加强企业内部的财务管理,搞好经济核算和经济活动分析。
第二十七条 劳动就业服务企业的资金来源主要采取国家和主办单位扶持、银行贷款、职工集资入股和集体公共积累等多渠道筹集。劳动就业服务企业安置主办单位待业人员、兴办为主办单位生产配套和为职工生活服务的项目时,所需资金主要由主办单位筹措解决。
第二十八条 劳动就业服务企业内部财务管理实行统一领导、分级管理、独立核算、自负盈亏。企业必须按规定设立财务机构,配备财务人员,建立健全财务制度,接受上一级单位的监督指导。
第二十九条 劳动就业服务企业享受国家减免的税金和主办单位提供的扶持资金要用于发展生产,不得用于非生产性支出和个人分配。
第三十条 劳动就业服务企业发展生产资金不足时,由主办单位担保向银行贷款。
第三十一条 劳动就业服务企业要严格执行国家税收政策。税后利润由企业依法自主支配,企业应按照国家规定确定公积金、公益金、奖金和股金分红的比例。
第三十二条 劳动就业服务企业对职工个人出资可以实行付息或者分红的办法。企业盈利,按一定比例付息或者分红;企业亏损,在弥补亏损之前,不得付息或者分红。付息或者分红的比例按国家有关规定执行。
第三十三条 劳动就业服务企业实行经理(厂长)任期终结审计制。由主管部门会同主办单位具体实施。

第七章 劳动人事管理
第三十四条 劳动就业服务企业按照灵活方便、合同管理、骨干稳定、合理流动的原则,自主选择用工形式。
从业人员在劳动就业服务企业工作期间应当计算工龄。
第三十五条 主办单位职工到劳动就业服务企业工作,仍保留其全民所有制职工身份,退休后回原单位领取退休金并享受退休人员的一切待遇。
第三十六条 劳动就业服务企业要培养选拔集体所有制职工担任各级领导干部,任职期间享受同级干部待遇。
第三十七条 劳动就业服务企业可根据国家有关规定和企业经济效益,自主确定适合本企业情况的工资和奖金的分配形式和办法。工资奖金水平要与企业经济效益紧密挂钩,效益好的企业,依照国家有关规定在保证上缴税金各集体积累的前提下,工资奖金水平可高于主办单位。效益差的企业要停发或者减发奖金,限期不能扭亏的企业,工资要适当下浮。
第三十八条 劳动就业服务企业要搞地对从业人员的培训教育工作,坚持就业前培训和岗位培训,生产单位人员达不到专业技术要求的不得上岗操作。
第三十九条 劳动就业服务企业从事化工有毒有害作业的人员,应按工种范围和当地规定的限额标准实行有毒有害岗位津贴制度。
第四十条 劳动就业服务企业要建立养老保险制度并逐步建立待业保险制度。保险项目和标准,按国家有关规定执行。保险基金专项储存、专款专用。

第八章 民主管理
第四十一条 劳动就业服务企业要建立职工(代表)大会制度:
(一)一百人以下的劳动就业服务企业,建立职工大会制度;
(二)三百人以上的劳动就业服务企业,建立职工代表大会制度;
(三)一百人以上三百人以下的劳动就业服务企业,建立职工大会或者职工代表大会制度,由企业自定。
职工代表大会由职工选举产生。
第四十二条 劳动就业服务企业职工(代表)大会在国家法律、法规的规定范围内行使下列职权:
(一)审议和通过企业发展规划;
(二)审议经理(厂长)提交的各项议案、决定企业经营管理的重大问题;
(三)审议企业职工工资形式、工资调整方案、奖金和分红方案、职工住宅分配方案和其他有关职工生活福利的重大事项;
(四)审议并决定企业职工奖惩办法和其他重要规章制度;
(五)法律、法规规定的其他职权。
第四十三条 劳动就业服务企业的职工(代表)大会,应当设立常设机构,负责职工(代表)大会闭会期间的工作。
常设机构的人员组成、产生方式、职权范围及名称,由劳动就业服务企业职工(代表)大会规定,报主办单位备案。

第九章 思想政治工作
第四十四条 中国共产党在劳动就业服务企业的基层组织是劳动就业服务企业的政治领导核心,领导企业思想政治工作,保证监督党和国家的方针、政策在本企业的贯彻执行。
第四十五条 劳动就业服务企业的党组织要搞好党的思想、组织、作风建设,健全基层组织,加强领导班子建设,在主办单位党组织的领导下开展各项工作。
第四十六条 劳动就业服务企业要加强共青团的工作,充分发挥团组织的作用,培养和建设“四有”职工队伍。
第四十七条 劳动就业服务企业要坚持党的思想政治工作的优良传统,运用多种形式开展理想信念、职业道德等方面教育,活跃职工文化生活,增强企业的凝聚力,搞好两个文明建设。

第十章 附则
第四十八条 地方化工主管部门可根据本办法并结合具体情况制定实施细则,并报部备案。
第四十九条 本办法由化学工业部负责解释。
第五十条 本办法自发布之日起施行。

  efinition of bill of exchange
  A bill of exchange is an unconditional order in writing, addressed 
by
  person to another, signed by the person giving it, 
requiring the
  on to whom it is addressed to pay on demand or at a 
fixed or
  rminable future time a sum certain in money to, or to the order
of, a
  ified person or to bearer.
  An instrument which does not comply with these conditions, or 
which
  rs any act to be done in addition to the payment of money, is 
not a
  of exchange.
  An order to pay out of a particular fund is not
  nditional within the meaning of this section; but an unqualified
order
  ay, coupled with--
  an indication of a particular fund out of which the drawee 
is to
  burse himself or a particular account to be debited with the 
amount;
  
  a statement of the transaction which gives rise to the 
bill, is
  nditional.
  A bill is not invalid by reason--
  that it is not dated;
  that it does not specify the value given or that any value has

  An inland bill is a bill which is or on the face of it purports
to be-
  
  both drawn and payable within the Colony; or
  drawn within the Colony, upon some person resident therein.
  Any other bill is a foreign bill.
  Unless the contrary appears on the face of the bill, the holder 
may

  A bill may be drawn payable to, or to the order of, the drawer;
or it
  be drawn payable to, or to the order of, the drawee.
  Where, in a bill, drawer and drawee are the same person, or where 
the
  ee is a fictitious person or a person not having capacity to
contract,
  holder may treat the instrument, at his option, either as a 
bill of

  Where a bill is not payable to bearer, the payee must be 
named or
  rwise indicated therein with reasonable certainty.
  A bill may be made payable to two or more payees jointly, or it
may be
  payable in the alternative to one of two or one or some of 
several
  es. A bill may also be made payable to the bolder of an office
for the
  being.
  Where the payee is a fictitious or non-existing person, the bill 
may
  reated as payable to bearer.

  Where a bill contains words prohibiting transfer, or 
indicating an
  ntion that it should not be transferable, it is valid as between 
the
  ies thereto, but is not negotiable.
  A negotiable bill may be payable either to order or to bearer.
  A bill is payable to bearer which is expressed to be so payable,
or on
  h the only or last indorsement is an indorsement in blank.
  A bill is payable to order which is expressed to be so payable, 
or
  h is expressed to be payable to a particular person, and 
does not
  ain words prohibiting transfer or indicating an intention 
that it
  ld not be transferable.
  Where a bill, either originally or by
  rsement, is expressed to be payable to the order of a 
specified
  on, and not to him or his order, it is nevertheless payable to
him or
  order at his option.

  The sum payable by a bill is a sum certain within the meaning of 
this
  nance, although it is required to be paid--
  with interest;
  by stated instalments;
  by stated instalments, with a provision that, upon default in 
payment
  ny instalment, the whole shall become due;
  according to an indicated rate of exchange or according to a rate 
of
  ange to be ascertained as directed by the bill.
  Where the sum payable is expressed in words and also in figures, 
and
  e is a discrepancy between the two, the sum denoted by the words 
is
  amount payable.
  Where a bill is expressed to be payable with
  rest, unless the instrument otherwise provides, interest runs
from the
  of the bill, and, if the bill is undated, from the issue thereof.

  Bill payable on demand
  A bill is payable on demand--
  which is expressed to be payable on demand, or at sight, 
or on
  entation; or
  in which no time for payment is expressed.
  Where a bill is accepted or indorsed when it is overdue, it shall, 
as
  rds the acceptor who so accepts or any indorser who so indorses
it, be
  ed a bill payable on demand.

  Bill payable at future time
  A bill is payable at a determinable future time within the meaning 
of
  Ordinance which is expressed to be payable--
  at a fixed period after date or sight;
  on or at a fixed period after the occurrence of a specified 
event
  h is certain to happen, though the time of happening may be
uncertain.
  An instrument expressed to be payable on a contingency is not a 
bill,
  the happening of the event does not cure the defect.

  Omission of date in bill payable after date
  e a bill expressed to be payable at a fixed period after 
date is
  ed undated, or where the acceptance of a bill payable at a 
fixed
  od after sight is undated, any holder may insert therein the true
date
  ssue or acceptance, and the bill shall be payable 
accordingly:

  where the holder in good faith and by mistake inserts a wrong 
date;
  
  n every case where a wrong date is inserted, if the bill
  equently comes into the hands of a holder in due course, the 
bill
  l not be avoided thereby, but shall operate and be payable as if 
the

  Ante-dating and post-dating
  Where a bill or an acceptance or any indorsement on a bill is 
dated,
  date shall, unless the contrary is proved, be deemed to be the 
true
  of the drawing, acceptance, or indorsement, as the case may be.
  A bill is not invalid by reason only that it is ante-dated or 
post-

  Definition and requisites of acceptance
  The acceptance of a bill is the signification by the drawee of

  An acceptance is invalid unless it complies with the

words, is

  it must not express that the drawee will perform his promise by

  Time for acceptance
  A bill may be accepted--
  before it has been signed by the drawer, or while 
otherwise

  when it is overdue, or after it has been dishonoured by a

  When a bill payable after sight is dishonoured by non-acceptance,

  drawee subsequently accepts it, the holder, in the absence 
of any

  General and qualified acceptance
  An acceptance is either (a) general; or (b) qualified.
  A general acceptance assents without qualification to the order
of the
  er. A qualified acceptance in express terms varies the effect of

  In particular, an acceptance is qualified which is--
  conditional, that is to say, which makes payment by the 
acceptor
  ndent on the fulfilment of a condition therein stated,

  Inchoate instruments
  Where a simple signature on a blank paper is delivered by the 
signer
  rder that it may be converted into a bill, it operates as a 
prima
  e authority to fill it up as a complete bill for any amount, using
the
  ature for that of the drawer, or the acceptor, or an indorser;
and, in
  manner, when a bill is wanting in any material particular, the
person
  ossession of it has a prima facie authority to fill up the omission
in

  In order that any such instrument, when completed, may be 
enforceable
  nst any person who became a party thereto prior to its completion, 
it
  be filled up within a reasonable time and strictly in accordance

天津市人民政府


《关于修改〈天津市河道、水库供水管理办法〉的决定》已经市人民政府批准,现予发布施行。


市人民政府决定对《天津市河道、水库供水管理办法》(1993年市人民政府令第57号)作如下修改:
一、将标题中的顿号删除。
二、将第一条修改为:“为加强我市河道、水库的供水管理,依据国家法律、法规及有关规定,结合本市情况,制定本办法。”
三、将第十条修改为:“对私自引水的,水利部门除对其私引水量按计划供水水费标准的12倍收取水费外,责令其停止违法行为,并给予警告或者处以罚款。私引水量按取水设施最大引水能力和私引水时间(最低以24小时计)计算。
前款规定的罚款,对非经营性私自引水的处以1000元以下罚款;对经营性私自引水但无违法所得的处以1万元以下罚款;对有违法所得的处以3万元以下罚款。”
四、将第十六条修改为:“市和区、县水利局可以委托其所属的河道、水库供水管理机构对违反本办法的行为实施处罚。”
本决定自发布之日起施行。
《天津市河道、水库供水管理办法》根据本决定作相应的修正,重新发布。

天津市河道水库供水管理办法

(1993年4月8日市人民政府发布1998年1月7日根据市人民政府《关于修改〈天津市河道、水库供水管理办法〉的决定》修订发布)


第一条 为加强我市河道、水库的供水管理,依据国家法律、法规及有关规定,结合本市情况,制定本办法。
第二条 本办法适用于本市行政区域内的供水河道和水库。凡由本市供水河道和水库供水及从本市供水河道和水库取水的单位和个人,必须遵守本办法。
第三条 市水利局是本市河道和水库供水管理的主管机关,负责河道、水库供取水计划的制定和实施、水源调度、水量分配及水利工程水费(以下简称水费)征收等。
第四条 河道、水库供水实行统一领导,分级管理。
(一)市水利局负责引滦输水河道——州河(含■河三岔口闸下段)、引滦明渠、新引河、潮白新河、蓟运河、青龙湾河、子牙河(八堡拦河闸以下段)、海河(二道闸以上段)、北运河(屈家店闸以下段)、独流减河、北大港水库、尔王庄水库、于桥水库的供水管理(以下简称市直
管)。
(二)区、县水利局负责对二级河道、中小型水库的供水管理(以下简称区县管)。
第五条 供水计划的管理。
(一)从市直管河道、水库取水的企事业单位、驻津单位年度用水计划应于上年年底以前向市水利局申报;农业、菜田、水产养殖、乡镇企业等用水,年度计划由所在区、县水利局于上年年底前汇总报市水利局审批。
(二)从区县管河道、水库取水的,向所在区、县水利局申报用水计划。
(三)对当年申报当年用水计划的,除特殊情况外严格控制审批。
第六条 市、区、县水利局批准下达的年度用水计划,水利部门和用水单位应严格执行。用水单位因故需变更用水计划的,应提前3个月向原批准部门提出计划变更申请,办理批准手续。
第七条 企事业用水单位取水,必须在取水口安装经水利部门认可的计量仪表,按批准的用水指标引水。未安装计量仪表或计量仪表失常的,按取水设施最大设计出水量(过水量)核算。
农业用水凭交费后付给的用水证引水。引水泵站、引水闸涵,必须安装专用电表和测流设施。引水期间,用水单位应配合供水管理人员做好护水检查,并接受监督。
对引水闸涵不具备测流条件的,水利部门应协助其建立测流设施,所需费用由用水单位承担。
第八条 区、县水利局在市直管河道的工程设施进行试车、试提闸,必须事先征得市水利局同意。未经同意试车、试提闸的,损失水量应交纳水费,并核减其用水指标。
第九条 用水单位超计划用水,除按标准水价收取水费外,超计划部分按下列规定累进加价收费:
超计划10%以下的(含10%),按标准水价的1倍加收费用;
超计划11%至20%的,按标准水价的2倍加收费用;
超计划21%至30%的,按标准水价的3倍加收费用;
超计划31%至40%的,按标准水价的5倍加收费用;
超计划40%以上的(不含40%),按标准水价的10倍加收费用;
市公用局所属从河道、水库取水的供水单位超计划用水的,暂不实行累进加价收费。
从市公用局所属的供水单位取水的,超计划用水按照津政发〔1986〕143号文件执行。
第十条 对私自引水的,水利部门除对其私引水量按计划供水水费标准的12倍收取水费外,责令其停止违法行为,并给予警告或者处以罚款。私引水量按取水设施最大引水能力和私引水时间(最低以24小时计)计算。
前款规定的罚款,对非经营性私自引水的处以1000元以下罚款;对经营性私自引水但无违法所得的处以1万元以下罚款;对有违法所得的处以3万元以下罚款。
第十一条 水利部门应严格执行供水计划,在供水计划不能正常执行时,水利部门应及时通知用水户调整用水计划。
第十二条 市直管河道、水库的水费,由市水利局计量征收管理。区、县管河道、水库的水费,由区、县水利局计量征收管理。
第十三条 河道、水库的水费标准,按市物价部门的规定执行。
第十四条 城市生活、工业、乡镇企业应按月结算水费。对拖欠水费超过1周的,每逾期拖欠1天按应交水费的1%增收滞纳金。对违反本办法取用水以及逾期3个月仍不交纳水费的,除征收滞纳金外,水利部门应采取必要措施直至停止供水。
农业、菜田用水先交费后引水。
第十五条 水费(含超计划用水加价的水费)纳入预算管理,专户储存,专款专用,用于河道和水库管理、维护和设施更新改造。
第十六条 市和区、县水利局可以委托其所属的河道、水库供水管理机构对违反本办法的行为实施处罚。
第十七条 本办法自发布之日起施行。
